Terms & Conditions

By making payment, the Customer (“you”) understand and agree to Colwick Park TMD Weathering’s (“we”, “us”, “our”) Terms & Conditions outlined below.

This agreement applies to all model weathering and custom painting services provided by Colwick Park TMD Weathering.

Services

You must provide specific reference photos, colour choices or weathering requirements (eg. Heavy rust, light rust) before work begins.

Weathering is a highly artistic process. By booking our services, you accept our unique artistic style. Minor variations from reference materials are natural and do not constitute a defect.

Customers must supply models fully assembled and ready for the weathering process by us unless alternative arrangements are agreed upon in writing.

We reserve the right to reject models that arrive unassembled, poorly built or structurally unsound. Any extra cleaning or repair work required to make the model fit for weathering will incur additional bench fees, which will be advised in writing.

Price Promise

Price matching is not available – our weathering prices are based on years of uniquely skilled work.

The price quoted is for the design discussed. Any changes to the design may increase the price if more complex weathering is involved. 

Revisions and Approval

We will provide photographic updates at key stages (e.g., base weathering completed) for your approval, when requested.

Payment

No orders are booked and secured into the diary until the payment has been received in full.

Delivery to Colwick Park TMD Weathering by You

In-Person Drop-Off/Collection: Local drop-offs and collections are strictly by prior appointment only at our designated address.

Postal Delivery: If sending models by post, you must use a tracked and insured service (e.g., Royal Mail Special Delivery or an equivalent courier). You must ensure models are packaged securely in the original manufacturers packaging, where possible, then placed inside a rugged outer box lined with adequate bubble wrap and padding.

Transit Risk: We accept no responsibility for models lost, delayed, or damaged in transit while being sent to our address

Return Shipping & Despatched Items to You

All completed items sent back to you will be packaged to a high standard and dispatched via a trackable, insured service.

In the rare event of transit damage upon return, you must notify us within [e.g., 48 hours] of delivery, providing clear photographs of both the damaged packaging and the model.

Because weathered miniatures are highly fragile, minor parts (such as antennae or small parts) coming loose during transit is a known risk. Re-gluing these minor parts remains the responsibility of the Customer.

Cancellation

We retain the right to cancel the booking in very unusual circumstances beyond our control, such as fire or ill health, during which we will refund any money taken in full.

In accordance with the UK Consumer Contracts Regulations 2013, goods made to a customer's unique specifications or personalized commissions are exempt from the standard 14-day statutory right to cancel once work has actively commenced.

If you cancel the project before work begins, any models already sent to us will be returned at your expense.

All cancellations MUST be in writing.

Refunds

Refunds are given only in exceptional circumstances as deemed appropriate by Colwick Park TMD Weathering.

Privacy

Your privacy is very important to us. We respect your privacy and comply with the General Data Protection Regulation with regards to your personal information.

What information We will collect:

• Personal Details: Names, email addresses, phone numbers, and billing/shipping addresses.

• Service Specifics: Descriptions, item conditions, or photographs of the specific locomotives, commissions, or layouts the customer wants weathered.

How We will use the information:

• To provide quotes and process custom weathering commissions.

• To send progress updates where requested (e.g., sending step-by-step photos of the airbrushing or weathering washes for approval).

• To securely ship the completed models back to You.

Third-Party data sharing:

We will only share your data where necessary in relation to your order only.

• Couriers and Postal Services: We will share names, addresses, and sometimes email/phone numbers with delivery services (e.g., Royal Mail, Courier Service Providers) to ensure tracked return delivery of Your models.

• Payment Processors: We use secure third parties (e.g., bank transfers, PayPal) to handle transactions, meaning We never directly see or store Your bank/credit card details.

Data Retention:

We will keep Your contact info and commission history for a few years to handle follow-up work or future loyalty discounts.

Intellectual Property and Marketing

Model weathering is highly visual. We retain the right to photograph, film, and share images or videos of the models (before, during, and after weathering) on our website, portfolio, and social media channels for marketing purposes. We will reference Your ‘First Name’ and ‘County’ only when posting content on Our social media outlets and on Our website (e.g Paul from Nottinghamshire).

If the commission is a time-sensitive surprise or gift, please inform us in advance so we can delay publishing images until an agreed date.

Governing Law & Complaints

These terms and conditions are governed by and construed in accordance with the laws of [England and Wales / Scotland / Northern Ireland], and any disputes will be subject to the exclusive jurisdiction of the local courts.

We try to avoid any dispute. If you have a complaint, please contact us in writing to colwickparktmd@gmail.com within 48 hours of delivery providing clear photos and a detailed description of the complaint and we will aim to respond within 2 working days to help find a solution.
